  2. U.S. Department of Veterans Affairs (VA) Publishes Final Rule to Help Veterans Exposed to Agent Orange

    Veterans exposed to herbicides while serving in Vietnam and other areas will find it easier to access quality health care and qualify for disability compensation under a final rule published in the Federal Register.  The new rule expands the list of health problems VA will presume to be related to Agent Orange and other herbicide exposures, which will speed up the application process.  VA is adding Parkinson’s disease and ischemic heart disease and expanding chronic lymphocytic leukemia to include all chronic B cell leukemias, such as hairy cell leukemia.

  3. U.S. Department of Labor's Office of Disability Employment Policy Announces Nearly $1 Million in Continued Funding for Youth Center

    The U.S. Department of Labor's Office of Disability Employment Policy announced that it will award nearly $1 million to continue funding the Youth Technical Assistance Center through the National Collaborative on Workforce and Disability for Youth. NCWD/Youth helps state and local workforce development systems to better serve youth with disabilities and their families in the areas of education, employment and independent living.  Read more about NCWD/Youth and its partners.

  4. U.S. Department of Transportation (DOT) Issues Updated "Fly Rights" Consumer Guide

    The U.S. Department of Transportation (DOT) has released an updated version of Fly Rights: A Consumer Guide to Air Travel, its popular guide to air travelers’ rights.  Fly Rights provides air travelers with helpful advice on how to get the best airfare, what to expect when a flight is delayed or canceled and how to avoid travel scams.  The guide provides easy-to-read information on federal airline regulations in a number of areas, including accommodating air travelers with disabilities and rules for bumping and baggage compensation. For more information read New Horizons - Information for the Air Traveler with a DisabilityNew Horizons can also be downloaded in Word format.

  5. U.S. Equal Employment Opportunity Commission (EEOC) Sues Two Texas Energy Corporations for Disability Discrimination

    The EEOC has filed two recent lawsuits to enforce the Americans with Disabilities Act (ADA).  In a suit against ENGlobal Engineering, Inc., the EEOC claims that the company terminated an employee because he was disabled. The employee had been diagnosed with multiple sclerosis (MS) symptoms two weeks after starting work. After taking medical leave, the employee gave the company a doctor’s note stating that he had clearance to return to work. Instead, ENGlobal falsely told him that his position was unavailable. In a suit against DynMcDermott, the company violated the ADA as well, when it refused to hire a job applicant because of his age and his wife’s cancer, which the company’s director assumed would interfere with his ability to do the job.

  6. AirTran Fined for Violating Rules Protecting Air Travelers with Disabilities

    The U.S. Department of Transportation (DOT) has assessed a civil penalty of $500,000 against AirTran Airways for violating rules protecting air travelers with disabilities.  The Air Carrier Access Act of 1986 requires airlines to provide assistance to passengers with disabilities in boarding and deplaning aircraft, including the use of wheelchairs, ramps, mechanical lifts or service personnel where needed. DOT found several violations of the requirement for boarding assistance.  In addition, the carrier’s complaint files showed that it frequently did not provide an adequate written response to complaints from passengers.

  7. Bureau of Labor Statistics Releases First-time Data on Employment of Persons with a Disability

    Persons with a Disability: Labor Force Characteristics 2009 is the first news release focusing on the employment status of persons with a disability. The information in this release is from the Current Population Survey (CPS), a monthly sample survey of about 60,000 households that provides statistics on employment and unemployment in the United States.  Some highlights from the 2009 data are - the unemployment rate for persons with a disability was 14.5 percent in 2009, well above the figure of 9.0 percent for those with no disability; and nearly one-third of workers with a disability were employed part time, compared with about one-fifth of those with no disability.

  8. Veterans with Disabilities to Learn Life-Changing Skills at Summer Sports Clinic in San Diego

    The third National Veterans Summer Sports Clinic, sponsored by the U.S. Department of Veterans Affairs (VA), will be held September 19 - 25, 2010 in San Diego, CA.  The event will teach recently-injured Veterans adaptive kayaking, sailing, track and field, cycling and surfing. Participation is open to Veterans who are eligible for VA medical care and have orthopedic amputations, traumatic brain injuries, burn injuries, psychological trauma, certain neurological conditions, visual impairment, spinal cord injuries or other injuries.  A fact sheet about this sports clinic can be downloaded in PDF format.

  9. U.S. Government Accountability Office (GAO) Report: Actions That Could Increase Work Participation for Adults with Disabilities

    On March 16, 2010 GAO held a forum to discuss actions that could be taken to help adults with a current or past work history improve their participation in the workforce.  As a result of this forum and survey results, GAO prepared this report, Highlights of a Forum: Actions that Could Increase Work Participation for Adults with Disabilities.  Participants agreed that a more coordinated system of programs and benefits is needed to encourage individuals to work and remove barriers that can jeopardize the services and supports they depend on.  A one-page summary of three report is also available.  This link opens a PDF document.

  12. U.S. Department of Education Awards $28.8 Million to School Districts to Improve Readiness & Emergency Response Plans

    School districts across the country will be able to improve and strengthen their emergency management plans as a result of $28.8 million in grants awarded by the U.S. Department of Education. The Readiness and Emergency Management for Schools (REMS) grants school districts improve plans that address all phases of emergency management.   Projects should include plans that prepare districts for infectious disease outbreaks and take into consideration districts’ special needs populations.

  13. U.S. Equal Employment Opportunity Commission (EEOC) Sues Princeton HealthCare System for Disability Discrimination

    The EEOC charged Princeton HealthCare System, which operates a hospital and provides other health care services, with violating federal law by failing to reasonably accommodate the needs of its employees who needed medical leave. More than a dozen employees with disabilities who requested a leave of absence as a reasonable accommodation were denied leave and were fired by Princeton HealthCare. The EEOC filed suit (EEOC v. Princeton HealthCare System) in the U.S. District Court for the District of New Jersey after first attempting to reach a pre-litigation settlement through its conciliation process.

  14. Axiom Staffing Will Pay $35,000 to Settle U.S. Equal Employment Opportunity Commission (EEOC) Disability Discrimination Suit

    Two staffing agencies will pay $35,000 and provide equitable relief to settle a disability discrimination lawsuit. The EEOC charged Axiom Staffing Group, Inc., and Axiom Staffing Group of Virginia, Inc., with refusing to place an applicant because of a back impairment. The consent decree settling the lawsuit forbids Axiom Staffing Group of Virginia from engaging in any employment practice which discriminates on the basis of disability. Axiom also will provide additional training on the requirements of the Americans with Disability Act and post a notice regarding the resolution of the lawsuit.

  17. U.S. Department of Justice (DOJ) Department Files Lawsuit for Disability-based Housing Discrimination in Louisville, KY

    DOJ has filed a lawsuit against the owners, developers, architects and civil engineers of Park Place Apartments in Louisville, Kentucky. The lawsuit alleges that these apartments fail to provide accessible features required by the Fair Housing Act. Some of the design and construction discrimination includes units with interior doors that are too narrow for persons who use wheelchairs. Since 1991, federal law has required that new multi-family housing complexes with four or more units be built with certain accessible features.

  18. Funding to Improve Outcomes for Individuals Receiving Social Security Disability Insurance (SSDI) Served by State Vocational Rehabilitation (VR) Agencies

    The purpose of this program is to expand and improve rehabilitation and other services authorized under the Rehabilitation Act of 1973, as amended, or to support activities that increase the provision, extent, availability, scope, and quality of rehabilitation services provided under the Act. Eligible applicants include states and public or nonprofit agencies and organizations, including  institutions of higher education.  Application deadline is September 8, 2010.

  19. Kessler Foundation/National Organization on Disability 2010 Survey of Americans with Disabilities

    The 2010 Survey of Americans with Disabilities is the sixth effort over the past 24 years to assess the quality of life of people with disabilities on a wide range of critical dimensions, to measure the gaps between people with and without disabilities on these indicators, and to track them over time.  This year, three new indicators were added: technology, access to mental health services, and overall financial situation. While there has been modest improvement in a few areas, the general implication of the indicators is that twenty years after the passage of the Americans with Disabilities Act there has yet to be significant progress in most areas.  A summary of the survey results is also available.

  20. Equal Employment Opportunity Commission (EEOC) Releases Federal Work Force Report

    EEOC has released its Annual Report on the Federal Work Force for Fiscal Year (FY) 2009. The report assesses the state of equal employment opportunity throughout the federal work force – including trends in the composition of the workforce, and data concerning complaints of employment discrimination in the federal sector – and includes practical tips for agencies to improve their performance. Among the reports findings relating to people with disabilities is the fact that after a steady decline for the past ten years, the participation rate of employees with targeted disabilities in the federal work force held steady in FY 2009 at 0.88%. Despite a modest net gain of 236 employees in FY 2009 over FY 2008, Individuals with Targeted Disabilities still fell far short of the 2% goal set by EEOC’s LEAD Initiative.

  21. AT&T to Settle Disability Discrimination Suit

    AT&T Services, Inc. (AT&T) will pay a former employee $60,000 to settle a disability discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC).  The EEOC’s lawsuit in the U.S. District Court for the Western District of Texas in Austin, charged that AT&T violated the Americans with Disabilities Act by failing to hire an applicant as a cable splicer technician only because of his insulin use for type 2 diabetes.

  22. Federal Communications Commission (FCC) Takes Steps to Ensure Wireless Phones Are Hearing Aid-Compatible

    FCC has taken steps to make clear that the hearing aid compatibility rules cover customer equipment that contains a built-in speaker and is designed to be typically held to the ear.  The FCC’s order also modifies an exception in the existing rule so that all large entities are required to offer at least one hearing aid-compatible model after a two-year initial period.  FCC also adopted a Policy Statement that emphasizes to developers of new technologies the necessity of considering and planning for hearing aid compatibility at the earliest stages of the product design process.  This link opens a PDF document.

  23. August 6, 2010 Letter to State Medicaid Directors on Improving Access to Home & Community-Based Services

    Letter from Cindy Mann, Director, Centers for Medicare & Medicaid Services (CMS) about changes to Section 1915(i) of the Social Security Act which take effect on October 1, 2010. These changes include revised and new 1915(i) provisions for removal of barriers to offering home and community-based services (HCBS) through the Medicaid State plan.  Section 1915(i) gives states an opportunity to offer services and supports before individuals need institutional care. The letter provides states guidance on those important changes to the law. This link opens a PDF document.

  24. U.S. Department of Labor (DOL) Announces Grants for Cooperative Agreements under Disability Employment Initiative

    DOL’s Employment and Training Administration (ETA), in coordination with the Office of Disability Employment Policy (ODEP), has announced the availability of approximately $22 million for cooperative agreements to state Workforce Investment Act (WIA) administering entities. This funding is being used to implement the Disability Employment Initiative (DEI), under which the Department intends to make 6 to 10 grant awards that are designed to: (1) Improve educational, training, and employment opportunities and outcomes of youth and adults with disabilities who are unemployed, underemployed and/or receiving Social Security disability benefits; and (2) help these individuals find a path into the middle class through exemplary and model service delivery by the public workforce system.  A transcript of the recent webcast for persons interested in this initiative can be downloaded in PDF format.  Application deadline is September 8, 2010

  29. Access Board to Undertake Rulemaking on Classroom Acoustics to Improve Learning Environment for Young Children

    The way a classroom is built and how language and sounds are heard in it can be an educational barrier for children who have hearing loss, use cochlear implants, have speech impairments or learning disabilities. The Access Board will address acoustics in classrooms by referencing a voluntary consensus standard developed by the Acoustical Society of America with support from the Board. The Board's rulemaking will focus on adding scoping provisions to its ADA and ABA Accessibility Guidelines to apply specific technical standard to classrooms that are newly built or significantly renovated. The Board will gather information on cost impacts in preparation for a proposed rule that will be made available for public comment.

  31. Two New Reports on Affirmative Action & People with Disabilities

    The U.S. Department of Labor's Office of Disability Employment Policy has released two reports on affirmative action policies in relation to people with disabilities and Veterans with disabilities. The reports examine the regulations implementing Section 503 of the Rehabilitation Act and the Vietnam Era Veterans’ Readjustment Assistance Act to determine whether and how federal contractor affirmative action programs might be modernized to reduce barriers to employment and eliminate earnings gaps.   32. Office of Disability Employment Policy (ODEP) Alliance Partner Launches New Disability Employment Resource Web Page

    The Society for Human Resource Management (SHRM), which signed a new Alliance Agreement with ODEP in late 2009, has launched a new Disability Employment Resource Page. SHRM created this resource page with employers in mind to offer resources, articles and information to help recruit, hire and retain people with disabilities.  The new resource page also includes videos of experts in the field of disability employment.

  33. July 2010 Disability Employment Statistics Released

    The U.S. Department of Labor's Bureau of Labor Statistics has released disability employment statistics for July showing that the percentage of people with disabilities in the labor force was 21.5. By comparison, the percentage of persons with no disability in the labor force was 70.6. The unemployment rate for those with disabilities was 16.4 percent, compared with 9.5 percent for persons with no disability, not seasonally adjusted.

  34. Summary Report of Office of Disability Employment Policy's (ODEP) Listening Sessions

    ODEP held a series of six Listening Sessions in January - March 2010 to engage stakeholders across the nation. These sessions collected information and comments about best practices and key issues to be addressed by federal workforce systems regarding the employability, employment, workforce participation, retention and promotion of people with disabilities.   35. U.S. Department of Housing & Urban Development's (HUD) 2009 American Housing Survey

    HUD's 2009 American Housing Survey (AHS) shows that U.S. homes today are larger with more bedrooms and bathrooms than in 1973 when the survey was first conducted. The 2009 AHS includes detailed data for five metropolitan areas: Chicago, Detroit, Philadelphia, New York and Northern New Jersey. For the first time ever, the AHS also includes data on disability status of household members. The new AHS also includes two surveys of New Orleans and Seattle. The New Orleans survey provides an in-depth progress report of the redevelopment of the major cities following the hurricanes of 2005.

  36. Social Security Administration (SSA) Opens New National Hearing Center (NHC) to Reduce Backlog of Disability Cases

    The opening of a new NHC in St. Louis is SSA's fifth and largest center in the country.  It is located with two other new Social Security facilities, the National Case Assistance Center and the Midwest Training Center.  These three facilities will bring over 200 new federal jobs to St. Louis and help reduce the backlog of disability cases in this region of the country.  The NHC uses state of the art electronic video technology to hold disability hearings remotely throughout the country.  The new office initially will hear disability cases for Cleveland, Ohio and Minneapolis, Minnesota – cities with two of the most backlogged hearing offices in the nation.   39. New Health Care Access Guidance Promotes Preventive Medical Care Services for People with Mobility Disabilities

    The U.S. Department of Justice's Civil Rights Division and the U.S. Department of Health and Human Services' Office for Civil Rights has issued new technical assistance guidance for medical providers, which will help people with mobility disabilities obtain accessible medical care. Access to Medical Care for Persons with Mobility Disabilities will help medical care providers in understanding how the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act of 1973 apply to them.   40. U.S. Department of Housing & Urban Development (HUD) Charges Chicago Architect, Developer with Failure to Build Apartments Accessible to Persons with Disabilities

    HUD has filed housing discrimination charges filed against Hector Castillo, Hector Castillo Architects, Inc., and 914 W. Hubbard, Inc. for designing and building apartments that fail to meet the accessibility requirements of the Fair Housing Act. HUD's charge contends that their apartments are inaccessible to persons with disabilities.  The Fair Housing Act requires that multifamily housing built for first occupancy after March 13, 1991 contain accessible features for persons with disabilities.

  41. Statement by U.S. Secretary of Labor Hilda L. Solis on the 20th Anniversary of the Americans with Disabilities Act (ADA)

    "The ADA's 20th anniversary provides a unique opportunity for the Department of Labor to reaffirm its commitment to the ADA's principles of equality, access, and inclusion; and to recommit itself to ensuring that the goal of good and safe jobs for everyone includes workers with disabilities...according to recent data from the U.S. Department of Labor's Bureau of Labor Statistics, just one in five people with disabilities were in the labor force and the unemployment rate for those with disabilities remains much higher than the national average. Last week, the Department of Labor published an Advance Notice of Proposed Rulemaking inviting the public to assist in the revision of the regulations implementing Section 503 of the Rehabilitation Act of 1973 and strengthen disability regulations related to federal contractors.   42. President Obama Signs Independent Living Centers Technical Adjustment Act

    DOJ has filed a lawsuit against Dalton Township, MI for violations of the Fair Housing Act and the Americans with Disabilities Act.  Charges are that the township discriminated against persons with disabilities based on its treatment of a group home for persons recovering from drug and alcohol addiction and its failure to grant a reasonable accommodation or modification to the owner of the group home. The suit seeks a court order prohibiting future discrimination by the township and requiring the township to make a reasonable accommodation to permit the continued operation of Serenity Shores as a sober home for eight individuals and a resident manager.

  45. Library of Congress Announces Renewal of Exemptions of Copyright Law for Types of Work That Would Allow Accessibility

    The Library of Congress has renewed its exemption ruling of the Digital Millenium Copyright Act. There are categories of exemptions that allow digital rights management technology to access copyright works. This renewal directly affects access to written and visual content in all types of copyright material for the blind and those with visual impairments. Most e-books devices are still not accessible with screen readers or other assistive technology.

  46. Centers for Medicare & Medicaid Services (CMS) Announces $2.25 Billion in Grants to Support Community-Based Alternatives to Institutional Long Term Care

    Americans with disabilities will have more help to live independently and remain in their homes and communities, instead of facilities such as nursing homes, because of $2.25 billion in CMS grants to states. The new grants encourage states not yet part of the Money Follows the Person Rebalancing (MFP) Demonstration to apply for funds. Health and Human Services Secretary Kathleen Sebelius sent a letter to governors encouraging them to take advantage of the many community initiatives in the Affordable Care Act and to participate in the MFP demonstration.

  47. U.S. Department of Housing & Urban Development (HUD) Releases Fair Housing Report

    HUD has released its annual State of Fair Housing Report for 2009. It highlights the agency's progress in enforcing the Fair Housing Act, identifies challenges that remain and shows HUD's commitment to ending housing discrimination. The report covers the last full fiscal year of HUD's complaint investigations and fair housing activities. Discrimination based on a person's disability status continues to be the largest-single category for complaints. Of the 10,242 complaints filed with HUD and its fair housing partners during fiscal year 2009, 44 percent alleged disability discrimination. The report is available in PDF format.

  48. Great Lakes Region Americans with Disabilities Act (ADA) Center Releases Report Cards for Six States

    The DBTAC-Great Lakes ADA Center conducted a poll to learn more about the opinions of people with disabilities, their family members and individuals who work with people with disabilities about how well the ADA is being implemented in their communities. Over 3500 individuals took the poll across all six states served by the Center. Overall respondents indicated that while they saw progress over the past 20 years, barriers to community participation and employment continue. Reports are available for Illinois, Indiana, Michigan, Minnesota, Ohio and Wisconsin.

  49. U.S. Department of Labor (DOL) Seeks Public Input to Strengthen Disability Regulations

    DOL's Office of Federal Contract Compliance Programs wants input from the public on ways to strengthen its regulations requiring federal contractors to take affirmative action to hire and advance the employment of qualified individuals with disabilities. In an Advance Notice of Proposed Rulemaking the agency invites the public to help revise the regulations implementing Section 503 of the Rehabilitation Act of 1973. Input is requested on topics that include what employment practices have been successful in finding, hiring and advancing qualified individuals with disabilities, and what data is available that can be used to create hiring goals and determine their effectiveness. Comments can be submitted through the Federal eRulemaking Portal. Deadline for comments is September 21, 2010.

  50. President Issues Executive Order to Increase Federal Employment of Individuals with Disabilities

    During a July 26 ceremony on the South Lawn of the White House, President Barack Obama gathered with people with disabilities, advocates, lawmakers and federal officials to mark the 20th anniversary of the signing of the Americans with Disabilities Act. After his remarks, President Obama signed an Executive Order that will establish the Federal Government as a model employer of individuals with disabilities.  The order directs several federal agencies to design model recruitment and hiring strategies for agencies seeking to increase their employment of people with disabilities, as well as mandatory training programs for both human resources personnel and hiring managers on the employment of individuals with disabilities.

    The Justice Department has published four new Americans with Disabilities Act (ADA) proposalsThese advance notices of proposed rulemakings, published in the Federal Register on July 26, 2010, address the accessibility of websites, the provision of captioning and video description in movies shown in theaters, accessible equipment and furniture, and the ability of 9-1-1 centers to take text and video calls from individuals with disabilities.   55. U.S. Department of Labor (DOL) Releases New Study on Disability Program Navigator Initiative

    DOL has released an evaluation study of the Disability Program Navigator Initiative titled Use of One-Stops by Social Security Disability Beneficiaries in Four States Implementing Disability Program Navigator Initiative. This study showed that the One-Stop Career Centers are serving a large share of individuals receiving Social Security disability benefits. The study was conducted in Colorado, Iowa, Maryland and Oregon. The report is available for download after registering online.

  56. U.S. Department of Justice (DOJ) Reaches Settlement with Blockbuster Inc. under Americans with Disabilities Act (ADA)
    DOJ has announced a settlement agreement under the ADA with Blockbuster Inc. to ensure equal access to its stores nationwide for individuals with disabilities who use service animals. The settlement agreement requires that Blockbuster develop policies to ensure that individuals with disabilities who use service animals have full and equal enjoyment of its goods, services and facilities. Some changes to be made under the agreement include Blockbuster giving all of their employees across the country comprehensive training in ADA laws and compliance, posting its service animal policy on its website and in its stores, as well as creating a toll-free ADA complaint line.

  58. U.S. Justice Department (DOJ) Settles Voter Registration Case with New York State for Violating Rights of Students with Disabilities

    DOJ has announced a court-approved consent decree which resolves a 2004 lawsuit against New York State and its public university systems. The state failed to provide voter registration services at offices serving students with disabilities at public university and college campuses in the state. The lawsuit alleged that the state violated Section 7 of the National Voter Registration Act, which requires that voter registration services be provided at offices that provide state-funded programs for persons with disabilities. By the start of the 2010-2011 school year, disability services offices at each public university and college campus in the state will provide voter registration services to students with disabilities.

  59. U.S. Department of Justice (DOJ) Reaches Settlement with National Owner of Gas Stations on ADA Claims

    DOJ has announced a comprehensive settlement under the Americans with Disabilities Act (ADA) with QuikTrip Corporation, a private company that owns and operates more than 550 gas stations, convenience stores, travel centers, and truck stops in the Midwest, South and Southwestern U.S. Under the consent decree QuikTrip will create a $1.5 million compensatory damages fund for individuals who were victims of discrimination based on disability, as well as take steps to make its stores accessible. DOJ opened the investigation because of complaints about inaccessible parking by two individuals with disabilities in the Omaha, NE area. The lawsuit alleges that the investigation showed a nationwide pattern of discrimination on the basis of disability.   60. VA Makes Access to Health Care & Benefits Easier for Veterans with PTSD

    As President Barack Obama announced in his weekly address, the Department of Veterans Affairs (VA), led by Secretary Shinseki, will begin to make it easier for Veterans with Post Traumatic Stress Disorder (PTSD) to receive the benefits they need. Under the new rule, VA would not require corroboration of a stressor related to fear of hostile military or terrorist activity if a VA doctor confirms that the stressful experience recalled by a Veteran adequately supports a diagnosis of PTSD and the Veteran's symptoms are related to the claimed stressor. More than 400,000 Veterans currently receiving compensation benefits are service-connected for PTSD.

  61. Obama Administration Announces More Than $550 Million to Help Very Low Income Elderly & People with Disabilities Find Affordable Housing

    Thousands of senior citizens and persons with disabilities will soon be able to find affordable housing, thanks to more than $550 million in housing assistance announced by the U.S. Department of Housing and Urban Development (HUD). The funding will provide interest-free capital advances to non-profit developers so they can produce accessible housing, offer rental assistance and provide supportive services for the elderly and persons with disabilities. The grants are provided through HUD's Section 202 and Section 811 Supporting Housing programs and will fund 169 projects in 46 states.

  62. Health Services Provider Agrees to Settle EEOC Disability Discrimination Suit
    A Saginaw, MI health services provider will pay $45,000 and furnish other relief to settle a disability discrimination lawsuit brought by U.S. Equal Employment Opportunity Commission (EEOC). The EEOC had charged that Health Delivery, Inc. unlawfully refused to return to work an employee with a record of depression even though she had completed a course of treatment and had been approved to return to work. The company's alleged conduct violates the Americans with Disabilities Act (ADA).

  63. Pre-Existing Condition Insurance Plan Announced

    The U.S. Department of Health and Human Services has announced the establishment of a new Pre-existing Condition Insurance Plan (PCIP) that will offer coverage to uninsured Americans who have been unable to obtain health coverage because of a pre-existing health condition. PCIP will provide a new health coverage option for Americans who have been uninsured for at least six months, have been unable to get health coverage because of a health condition, and are a U.S. citizen or are residing in the United States legally.   64. U.S. Department of Health & Human Services (HHS) Provides $390.5 Million to Improve Hospital Preparedness & Emergency Response

    HHS has announced grants totaling $390.5 million to be awarded to states, territories and large metropolitan areas of New York City, Chicago, Los Angeles County and Washington, D.C., to help hospitals and other health care organizations prepare for an emergency. The funds will be provided through the Hospital Preparedness Program (HPP), which will help hospitals and health care facilities to respond to any emergency, such as natural disasters, disease outbreaks or acts of terrorism.   66. U.S. Department of Housing & Urban Development (HUD) Charges New York Apartment Management Company with Discriminating Against Child with Disabilities

    HUD has charged a landlord in Albany, NY with violating the Fair Housing Act by denying a child with disabilities a reasonable accommodation and retaliating against her family. The Paulsen Development Company barred the child from using the apartment complex swimming pool by prohibiting her needed service animal from accompanying her. After her mother complained to HUD, the company refused to renew their lease.

  68. U.S. Department of Justice Resolves Disability Discrimination Lawsuit against Fitchburg, Massachusetts Housing Authority

    The Justice Department (DOJ) has reached an agreement on a lawsuit against the Fitchburg, Massachusetts Housing Authority and its executive director, Robert W. Hill. The lawsuit alleged that the Fitchburg Housing Authority and Hill violated the Fair Housing Act (FHA) by adopting and implementing policies that denied tenants with disabilities (other than mobility impairments) the opportunity to transfer between apartments within Fitchburg's public housing neighborhoods. The FHA requires equal access to housing for all persons with disabilities, not just those who are substantially limited in walking. The law prohibits discrimination in housing based on race, color, religion, national origin, sex, disability and familial status.   69. U.S. Equal Employment Opportunity Commission (EEOC) Celebrates 45th Anniversary

    Created by the historic Civil Rights Act of 1964, the EEOC was founded to enforce Title VII of that Act, which prohibits discrimination in employment on the basis of race, color, religion, sex or national origin.   70. New Information Tool Gives Consumers More Control Over Their Own Health Care

    The U.S. Department of Health and Human Services has announced a new website called HealthCare.gov. This new tool lets consumers take control of their health care by connecting them to information about quality, affordable health care coverage. HealthCare.gov is the first central database of health coverage options--from Medicare to the new Pre-Existing Conditions Insurance Plan, and information from more than 1,000 private insurance plans. HealthCare.gov answers questions that relate to people with disabilities and health care, and also has information about insurance plans and community services in every state.   71. Eight Reports on Multisensory Programs for Students with Learning Disabilities

    The What Works Clearinghouse (WWC) has released eight new reports that review the research on Orton-Gillingham-based programs for students with learning disabilities. Orton-Gillingham teaching sessions are action oriented with auditory, visual and kinesthetic elements reinforcing one another. The Clearinghouse's review of the research on Project Read Phonology, a multisensory language arts curriculum designed for use in a classroom or group setting, found this intervention to have no discernible effects on general reading achievement for students with learning disabilities. WWC also reviewed studies on seven other programs.

  72. Joint DOJ-ED Letter to College & University Presidents on Electronic Book Readers

    The U.S. Department of Justice and the U.S. Department of Education have sent a letter to colleges and universities about the use of electronic book readers that are not accessible to students who are blind or have low vision. The letter points out a serious problem with some of these devices that do not have an accessible text-to-speech function. Requiring use of an emerging technology in a classroom environment when that technology is inaccessible to an entire population of individuals with disabilities-individuals with visual disabilities-may constitute discrimination prohibited by the Americans with Disabilities Act of 1990 (ADA) and Section 504 of the Rehabilitation Act of 1973 (Section 504).   73. New GAO Report Finds Students with Disabilities Face Challenges in Participating in School Sports

    The U.S. Government Accountability Office (GAO) has issued a report on the participation of students with disabilities in school athletics and physical education. The report found that students with disabilities participated in athletics at consistently lower rates than students without disabilities. Some schools or districts provide opportunities by partnering with community programs or offering athletics designed specifically for students with disabilities, such as wheelchair basketball. School officials also indicated a lack of information on ways to expand athletic opportunities, lack of clarity regarding schools' responsibilities and budget constraints as key challenges. The report makes recommendations on actions that the U.S. Department of Education should take to improve access to PE and extracurricular athletics to students with disabilities.     This article from the Society for Human Resource Management (SHRM) reports that an estimated 15 to 20 percent of the U.S. population has a disability that might affect their ability to use technology. In order to tap into this large talent pool of potential employees, employers need to make sure that their entire recruitment process is accessible--including their job application and recruitment websites.   78. New Guides Offer Hospitals Advice on Emergency Evacuation, Assessment & Recovery

    Two new guides from the Agency for Healthcare Research and Quality (AHRQ) can help hospital planners and administrators make important decisions about how to protect patients and health care workers during emergencies. The Hospital Evacuation Decision Guide and the Hospital Assessment and Recovery Guide help hospitals assess the physical components of a hospital when a natural or manmade disaster, terrorist attack, or other catastrophic event threatens the soundness of a facility.   79. Medicare Proposes New Rules to Ensure Equal Visitation Rights for All Hospital Patients
    The Centers for Medicare & Medicaid Services (CMS) has proposed new rules for hospitals that would protect patients' rights to choose their own visitors during a hospital stay, including visitors who are same-sex domestic partners. The proposed rules would require every hospital to have written policies and procedures about patients' visitation rights, as well as instances when the hospital may restrict patient access to visitors based on reasonable clinical needs.

  80. On 11th Anniversary of Olmstead, President Obama Highlights Administration's Actions to Promote Independence & Community Integration of Americans with Disabilities

    Last year, on the 10th anniversary of the landmark Supreme Court decision in the case of Olmstead v. L.C., President Obama launched The Year of Community Living. As part of this initiative, Secretary of Health and Human Services (HHS) Kathleen Sebelius created the Community Living Initiative to coordinate the efforts of federal agencies and support the Administration's commitment to addressing isolation and discrimination against people with disabilities. HHS awarded a $3.2 million contract to establish a Housing Capacity Building Initiative for Community Living to connect persons with disabilities to affordable housing in their communities.   81. Judge Orders State of Florida to Provide Community Services to Jacksonville Woman at Risk of Institutionalization

    A U.S. District Court in Jacksonville has ruled that the state of Florida must provide Michele Haddad with services that will let her stay in her home. Haddad, who has quadriplegia from a motorcycle accident with a drunk driver in 2007, has successfully resided in the community since the accident, but is at risk of having to go to a nursing home due to changes in her caregiver situation. Haddad has been on the waiting list for Medicaid community-based waiver services for two years, and she told the state of her increased need for services. She was informed that community services would only be available if she was willing to enter a nursing home for 60 days. The court ordered the state to provide community-based services as required by the Americans with Disabilities Act's (ADA) integration mandate in Olmstead v. L.C.

  82. Opening Doors: Federal Strategic Plan to Prevent & End Homelessness

    The United States Interagency Council on Homelessness has released a comprehensive federal plan that will serve as a roadmap for actions to prevent and end homelessness. The plan calls for ending chronic and Veterans' homelessness by 2015, and ending homelessness among children, family and youth by 2020.   83. Process & Criteria Used to Evaluate States' Requests to Waive Maintenance of Effort (MOE) Requirements under Part B of the Individuals with Disabilities Education Act (IDEA)

    The U.S. Department of Education's Office of Special Education and Rehabilitation Services (OSERS) will consider states' requests to be excused from MOE requirements under IDEA, Part B for education of students with disabilities on a case-by-case basis. Given the falloff in state revenues that has caused hardships for many states, some states are seeking to waive MOE requirements which would reduce the state's amount of financial support for special education and support services. Waivers will only be granted when a state demonstrates that it has experienced "exceptional or uncontrollable circumstances."   84. Eligibility for an Institution's Comprehensive Transition & Postsecondary Program (CTP) for Students with Intellectual Disabilities

    The Higher Education Act, as reauthorized by the Higher Education Opportunity Act (HEOA), includes information on the eligibility of students with intellectual disabilities to participate in the Federal Pell Grant, Federal Work-Study (FWS), and Federal Supplemental Educational Opportunity Grants (FSEOG) programs. Institutions that offer a CTP program can apply to have that program approved so that eligible students may receive Federal Pell Grant, FWS and FSEOG funds.   86. Connecticut First in Nation to Expand Medicaid Coverage to New Groups under Affordable Care Act

    Connecticut is the first state in the country to permanently add low-income adults to its Medicaid program under the new Affordable Care Act. Before health care reform was passed, states could only cover adults without children by applying for a waiver of Medicaid rules. These waivers were temporary and states had to meet strict criteria for approval and renewal. The Affordable Care Act requires states to cover all low-income individuals in Medicaid starting in 2014, but also allows states to get federal funding to enroll them right away.

    The IMLS is the primary federal source of support to over 140,000 museums and libraries nationwide.   88. VA Makes Filing Claims Easier & Faster for Veterans

    The Department of Veterans Affairs (VA) is reducing the paperwork and speeding up the process for Veterans seeking compensation for disabilities related to their military service. VA has shortened application forms to reduce paperwork for Veterans. The new forms include a shortened VA Form 21-526 for Veterans applying for the first-time to VA for disability compensation or pension benefits and VA Form 21-526b for Veterans seeking increased benefits for conditions already determined by VA to be service-connected.

  89. New Rule Extends Disability Protections to Passenger Ships & Boats

    The Department of Transportation (DOT) has announced the first federal rule to specifically provide Americans with Disabilities Act (ADA) protections to people with disabilities who travel on boats and ships. The rule applies to two categories of vessels - vessels operated by public entities, such as public ferry systems, and vessels operated by private entities that are mainly in the business of transporting people, such as cruise ships. Under the rule vessel operators cannot charge extra for accessibility-related services to passengers, cannot require passengers to furnish their own attendants, and cannot deny access to passengers based on disability. The new rule will become effective 120 days after it is published.

  96. U.S. Department of Housing & Urban Development (HUD) FY 2010 Notice of Funding Availability (NOFA) Policy Requirements

    This notice provides information about HUD's 2010 NOFA to help applicants submit successful applications. It also describes changes to HUD's policy priorities. Among these priorities are the design and construction of buildings and communities that are accessible and visitable by people with disabilities, the availability of supportive housing services and new housing construction that integrates people with disabilities into the general community.   97. Extra Help with Prescription Drug Costs for Medicare Beneficiaries

    More Medicare beneficiaries will soon qualify for help paying for their prescription drugs. People on Medicare may be eligible to pay no more than $2.50 for generic drugs and $6.30 for each brand name drug thanks to changes to Medicare's Low-Income Subsidy Program (also called "Extra Help") that take effect this year. Changes in the law will make it easier for Medicare beneficiaries to qualify for "Extra Help" by changing the way income and assets are counted in 2010. The Social Security Administration will no longer count life insurance policies as a resource. Also, help received from family and friends to pay for household expenses like food, mortgage, rent and utilities will no longer count as income.
